2. Intellectual Property

All content on this website, including but not limited to text, software, graphics, designs, interactive features (such as Rive animations, canvas scripts, and chatbot systems), logos, and code, is the property of Hinrichs Specialty Services and Technology or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access our website for personal or internal business evaluation. You may not copy, modify, distribute, sell, or lease any part of our site or software code without explicit written consent from Brandon Hinrichs.

3. Services and Payments

We provide professional consulting and digital solutions. The specific terms of custom projects (such as scopes, deliverables, timelines, and payment structures) will be outlined in a separate Statement of Work (SOW) or Client Service Agreement.

A. Standard Projects

• Flat-Rate Pricing: Custom website design, SEO optimization, and automation workflows are billed on a flat-rate, per-project basis as agreed in writing.
• Invoicing: Invoices are sent via Stripe and are due according to the terms specified on the invoice (typically net 15 or net 30).

B. Accountability Classes & Enrollment

• Class Fees: Program fees (e.g., intake fees, weekly class payments) must be paid prior to attending each session. Payments are processed securely via Stripe.
• No Refunds: Class fees and intake fees are non-refundable. Attendance records and compliance logs are recorded and reported in accordance with court or probation requirements.

4. Third-Party Payment Processing

HSST uses Stripe for secure payment processing. By making payments through our website or portal, you agree to Stripe's Services Agreement. HSST does not store or process your full card numbers, CVV, or bank credentials. We are not liable for any issues, security breaches, or errors arising from transactions handled by Stripe.

5. User Conduct and Responsibilities

When interacting with our website, submitting intake forms, using our client portal, or chatting with our virtual assistant, you agree not to:

• Submit false, misleading, or fraudulent information (such as fake names, emails, or probation case details).
• Use the site or Services for any unlawful purpose or in violation of local, state, or federal laws.
• Attempt to disable, bypass, or interfere with security features of our systems, including our forms and database rules.
• Transmit viruses, malware, or spam through our contact forms or chat portals.

6. Disclaimer of Warranties

OUR WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HINRICHS SPECIALTY SERVICES AND TECHNOLOGY AND ITS OWNER, BRANDON HINRICHS, SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, ARISING FROM YOUR ACCESS TO, OR USE OF, OUR SITE OR SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO HSST DURING THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

8. Governing Law & Jurisdiction

These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Nebraska, without regard to its conflict of law principles. Any legal action or proceeding relating to your access to, or use of, the website or Services shall be instituted exclusively in the state or federal courts located in Fillmore County or Lancaster County, Nebraska.
